The news
What is a WhatsApp chatbot and what has Meta’s policy changed?
Short answer
A WhatsApp chatbot is a program, now almost always AI-powered, that serves a company’s customers on WhatsApp through the WhatsApp Business API. Since 15 January 2026, Meta has banned general-purpose AI assistants from that API, but customer service, booking and sales bots are still allowed; since 1 October 2026, their replies are charged.
The change came on 15 October 2025, when Meta added a section on “AI providers” to the WhatsApp Business Solution Terms, the contract that governs the API. Companies that develop AI can no longer use the API when AI is the primary functionality, something Meta decides “in its sole discretion”.
The targets were ChatGPT, Copilot and Perplexity. According to TechCrunch, Meta argued that they were overloading an API designed for businesses, and gave a travel agency’s customer service bot as an example of permitted use. That left Meta AI as the only general assistant on WhatsApp, which is what Brussels and Italy are investigating.

What is allowed
Which chatbot for WhatsApp does Meta allow, and which does it ban?
Meta allows any chatbot for WhatsApp in which the AI serves your business, and bans the one that turns the AI into the product. The European Commission summed it up this way: businesses can keep using AI for ancillary functions, such as automated customer support.
If you already run a chatbot in WhatsApp for your customers, there is no need to worry. There are two nuances: the terms, amended on 6 March 2026, now accept general-purpose assistants for phone numbers from the European Economic Area (EEA) or Brazil, and no AI provider may train models on your conversations, except to fine-tune one for you alone.
| Criterion | Allowed? | Why |
|---|---|---|
| AI customer service (orders, deliveries, returns) | Yes | The AI is incidental to your service. |
| Bookings, appointments and sales from your catalogue | Yes | The conversation serves your business; it does not sell the AI. |
| General-purpose AI assistant as a product | Only in the EEA and Brazil | In the EEA, Brussels also requires free access. |
| Training models on your conversations | No | Not even with anonymised data; only fine-tuning for exclusive use. |
| Bot with no way to reach a person | No | The policy requires prompt, clear and direct escalation. |
| Messaging people who have not opted in | No | You need opt-in and must honour opt-outs. |
What has not changed for your business
Vendors sell it as a “chatbot WhatsApp” integration, a “WhatsApp chatbot” or an agent. What matters is whether it only answers or also acts in your systems: I explain the difference in the guide to AI agents vs chatbots vs automation. Put your judgement to the test:

Where do the European Commission and Italian investigations stand?
As of 12 October 2026, the European Commission is still investigating Meta and, in the meantime, requires it to give rival assistants free access in the EEA. Italy closed its case in May to leave it to Brussels.
The European Commission: from investigation to interim measures
Brussels opened the case on 4 December 2025 and on 9 February 2026 sent a statement of objections: Meta is likely to be dominant in messaging in the EEA. Meta responded on 4 March by letting the assistants back in, but charging between €0.0490 and €0.1323 per message depending on the country, according to TechCrunch.
On 15 April 2026, the Commission concluded on a preliminary basis that the fee amounted to the ban and extended the case to Italy. Meta stopped charging AI providers in the EU and EEA on 13 May, according to its developer documentation. Even so, on 9 June 2026 the Commission imposed interim measures: free access within 5 working days, with fines of up to 10% of turnover. ChatGPT is back on WhatsApp in the EEA, and in August Meta appealed to the General Court.
Italy: the AGCM led the way
The Italian Competition Authority (AGCM) had been investigating since July 2025 and on 22 December ordered Meta to suspend the new terms in Italy. On 19 May 2026 it closed the case without clearing Meta: the Commission’s extended case took the matter out of its hands.
- Main investigation: open in Brussels, with no legal deadline.
- Interim measures: in force, with Meta’s appeal pending.
- Your business WhatsApp chatbot: none of the above affects it.
This fight is between Meta and the AI makers. What affects your business is the messaging bill and the small print about your data.
Costs
How much does a WhatsApp chatbot cost with the WhatsApp Business API?
A chatbot on the WhatsApp Business API costs the sum of three layers: the messages Meta charges for, the provider that connects your number and the AI model. The first layer has just changed.
Since 1 July 2025, Meta has charged per delivered message, with rates by country. Each customer message opens a 24-hour window in which you can reply freely; outside it, only paid templates. And according to its documentation, since 1 October 2026 replies inside the window are charged too, whether a person or your AI writes them.
| Criterion | What it is for | How it is charged |
|---|---|---|
| Marketing template | Offers and news | Always, per message |
| Utility template | Order confirmations, delivery updates | Per message, with volume tiers; inside the window, from 1 Oct 2026 |
| Authentication template | Verification codes | Per message, with volume tiers |
| Service message | Free-form replies in the 24-hour window | Paid from 1 Oct 2026, no volume tiers |
| Meta Business Agent | Replies from Meta’s business AI | $2 per million tokens from 1 Aug 2026 |
| 72-hour free window | After a Click to WhatsApp ad | Free delivery; Meta Business Agent tokens are charged |

Is a WhatsApp chatbot free? Not since 1 October
My recommendation: measure the cost per resolved conversation. The best WhatsApp chatbot is not the one with the cheapest licence: an agent that resolves in three messages what a menu bot drags out to ten works out cheaper.
The options
WhatsApp AI chatbot for business: Meta Business Agent or your own agent?
If you mostly answer with public information (opening hours, catalogue, prices), Meta Business Agent may be enough; if the bot has to check or change data in your systems, you need the API and a custom AI agent. Note that “WhatsApp AI” also means Meta AI, the consumer assistant that reached 41 European countries in March 2025.
Option 1: Meta Business Agent, Meta’s own WhatsApp Business chatbot
Meta Business Agent, which Meta also calls Business AI, is switched on in the WhatsApp Business app. It learns from your chats, website and catalogue, and hands complex cases to a person. Meta offers it to eligible businesses in selected markets, without listing which ones.
- For: it is set up without any development work.
- Against: it cannot see your ERP or your calendar; an AI WhatsApp chatbot like this informs, but cannot act on real orders or bookings.
Option 2: a custom AI agent connected through the API
You connect your number to the API and an agent looks up the order in the ERP, moves the booking and logs it in the CRM. That is the WhatsApp chatbot example in the illustration at the top of this article. Many providers sell it as a WhatsApp Business chatbot, although once it acts it is really an agent. Meta allows it, and you choose the model, the provider and where the data is stored.
- For: it resolves cases end to end and does not lock you in to one provider.
- Against: it requires design, integration and maintenance.
A quick test to decide
Step by step
How do you build a WhatsApp chatbot with AI that complies with the policy and the GDPR?
A compliant WhatsApp chatbot is built from five pieces, with the GDPR handled from the design stage. People searching for how to “integrate chatbot with WhatsApp” usually picture a single connection; in practice it is these five. It is the pattern I follow as José Galán, Search & AI Visibility consultant and AI agent designer.
- A number on the WhatsApp Business API, through Meta’s Cloud API or a provider.
- A narrowly scoped agent: what it resolves (orders, bookings, returns) and what it does not.
- Least-privilege connections to the ERP and the calendar. The Model Context Protocol (MCP) for connecting AI to your systems simplifies this layer.
- Escalation to a person with the chat history, as the messaging policy requires.
- A log of what the agent looked up and did, in case of a complaint.
GDPR and AI Act checklist
- Privacy notice in the first message: who processes the data and why.
- AI disclosure. In the EU, Article 50 of the AI Act has required since 2 August 2026 that people are told they are talking to an AI, unless it is obvious.
- Processors. The WhatsApp Business Data Processing Terms make WhatsApp a processor; sign a data processing agreement with your platform and AI providers as well.
- Data in the EU. The Cloud API’s local storage option keeps messages at rest in the EU (Germany), although they may be processed outside it for up to 60 minutes.
Make sure nobody trains on your conversations
The legal detail is in the guide to the EU AI Act and the GDPR for SMEs. If you are torn between a bot that answers and one that acts, read what agentic AI is and what it can already do in business. It is what I design in my custom AI agents for customer service.
For your business
What does it mean for your business?
It means more cost and more obligations, not a ban: WhatsApp chatbots for customer service are still allowed.
ManagementMedium impact
Customer service on WhatsApp costs more since 1 October 2026. Decide on cost per resolved conversation and avoid being locked in to one provider.
MarketingMedium impact
Marketing messages are always paid and require opt-in; Click to WhatsApp ads give you 72 free hours. Getting ChatGPT or Google to recommend your brand is a different job: visibility in ChatGPT and Google.
Sales and customer serviceHigh impact
The area that gains and risks the most: a WhatsApp chatbot that resolves orders and bookings takes load off the team, but it needs a way out to a person.
IT and dataHigh impact
API integration, least-privilege access, logging, data in the EU and data processing agreements with every provider.
For context: what companies are really doing with AI for business.
Action
What should you do now with your WhatsApp chatbot?
Start by knowing what you have and what it costs you; the technology comes afterwards.
This week: take stock
Which number you use, whether it is on the app or the API, which provider you have and what your WhatsApp chatbot answers. Work out how many service replies you now pay for since the October change.
This week: check the mandatory items
AI disclosure, a clear route to a person and opt-in. Try asking to “speak to a person” yourself.
This month: review contracts and data
Ask your provider where it stores the messages, whether it trains models on them and which data processing agreement you have.
This quarter: pick one process and measure it
The one that generates the most messages: orders, bookings or returns. Measure it with the MAPA method for mapping and automating processes with AI; the MAPA template is among the free resources.
This quarter: run a pilot priced per resolution
Try Meta Business Agent or a connected agent and compare the cost per resolved conversation. If you are looking for AI agents designed around your processes, let’s talk.
Key points
- Meta bans general-purpose AI assistants outside the EEA and Brazil; your WhatsApp chatbot for customer service, bookings or sales is still allowed.
- Since 9 June 2026, Brussels has required Meta to give rival assistants free access; Meta has appealed.
- Since 1 October 2026, service replies inside the 24-hour window are charged per message.
- No provider may train its models on your WhatsApp conversations.
- Meta Business Agent or a connected agent: decide by how many enquiries require looking at real data.
FAQ
Frequently asked questions about the WhatsApp chatbot with AI
Can my business still use a WhatsApp chatbot with AI?
Yes. The ban Meta has applied since 15 January 2026 covers general-purpose AI assistants, whose product is the AI itself. A WhatsApp chatbot that serves your customers, handles bookings or tracks orders is still allowed, as long as it asks for prior consent (opt-in) and offers a clear way to reach a person.
What does the WhatsApp policy say about AI chatbots?
The WhatsApp Business Solution Terms, last amended on 6 March 2026, bar AI providers from the platform when AI is the primary functionality, except for users with phone numbers from the European Economic Area or Brazil. They also forbid using your conversations to train AI models.
Can businesses build their own custom AI chatbots on WhatsApp?
Yes, and in two ways. Meta Business Agent is set up in the WhatsApp Business app, learns from your chats, website and catalogue, and hands complex cases to a person. If the chatbot needs to check your ERP or your calendar, the route is the WhatsApp Business API with a custom AI agent.
How much does a WhatsApp chatbot cost with the API, and is any of it free?
It depends on volume and message type. Since 1 July 2025, Meta has charged per delivered message: marketing templates are always paid and, since 1 October 2026, so are replies inside the 24-hour customer service window. Only delivery in the 72-hour window after a Click to WhatsApp ad is free. Add the provider and the AI model on top.
What is the WhatsApp Business API and how is it different from the app?
The WhatsApp Business API, which Meta calls the WhatsApp Business Platform, connects WhatsApp to your systems: CRM, ERP, calendar or an AI agent. You use it through Meta’s Cloud API or a provider, and you pay per message. In the WhatsApp Business app, by contrast, the AI option is Meta Business Agent.
Does a WhatsApp chatbot comply with the GDPR and the EU AI Act?
It can, if it is designed to: a lawful basis, a privacy notice, a data processing agreement with each provider and minimum access to data. In the EU, the AI Act has required since 2 August 2026 that people are told they are talking to an AI, unless it is obvious.
Can I use ChatGPT on WhatsApp as my company’s chatbot?
Not directly. The ChatGPT that returned to WhatsApp in the European Economic Area in July 2026 is a consumer assistant with its own phone number. You can, however, connect your own API number to a model from OpenAI or another provider, without it training on your conversations.
